Step 1: Receiving Your Clearance Certificate (Up to 7 Days)
Once you have repaid all your debts in full under your debt review repayment plan, your debt counsellor is legally required to issue a clearance certificate (Form 19) within 7 days. This is stipulated under the National Credit Act.
In practice, some debt counsellors delay issuing this certificate, or in some cases, refuse to issue it. If your debt counsellor withholds your certificate without valid reason, you can apply to the Magistrate’s Court or Tribunal, which can order them to issue it. This delay can add weeks to the overall timeline.
Step 2: Submitting a Dispute to the Credit Bureaus (21 Business Days)
Once you have your clearance certificate, you (or your legal representative) must submit a formal dispute to each relevant credit bureau (TransUnion, Experian, XDS).
This is done through a credit clearance letter, along with supporting documents: your ID, proof of residence, and the clearance certificate.
Under the National Credit Act, bureaus have 21 business days to investigate and update their records. Once they confirm the dispute in your favour, the debt review flag must be removed from your profile.
